नई दिल्ली। SC on Delhi Ordinance केंद्र द्वारा लाए गए दिल्ली अध्यादेश के मामले को सुप्रीम कोर्ट संविधान पीठ के पास भेज सकता है। कोर्ट ने संकेत दिए है कि वह नौकरशाहों पर नियंत्रण से संबंधित इस अध्यादेश को पीठ को सौंप सकता है। बता दें कि केंद्र द्वारा जारी राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार (संशोधन) अध्यादेश 2023 की संवैधानिक वैधता को दिल्ली सरकार ने चुनौती दी है। सुप्रीम कोर्ट ने मामले की सुनवाई 20 जुलाई के लिए टाल दी है।

अध्यादेश लाने की जरुरत क्यों पड़ी
सुप्रीम कोर्ट में केंद्र (SC on Delhi Ordinance) की ओर से हलफनामा दाखिल में जानकारी दी गई कि आखिर उसे अध्यादेश लाने की जरूरत क्यों पड़ी? केंद्र ने कहा कि दिल्ली के मंत्रियों ने सोशल मीडिया पर आदेश अपलोड किए, जिसके बाद अधिकारियों की तलाश शुरू हो गई. केंद्र की ओर से कहा गया कि आम आदमी पार्टी की अगुवाई वाली दिल्ली सरकार ने सतर्कता अधिकारियों को निशाना बनाया और रात 11 बजे के बाद फाइलों पर कब्जा करने के लिए सतर्कता अधिकारियों तक पहुंच बना ली.
संविधान पीठ के पास भेजे जाने पर होगा फैसला
सीजेआई ने कहा कि 3 प्रविष्टियां हैं, जिन पर दिल्ली सरकार का कोई नियंत्रण नहीं होता है. उन्होंने जो किया है वह यह है कि 239 AA (vii) के तहत शक्ति का इस्तेमाल करके, उन्होंने सेवाओं को दिल्ली सरकार के नियंत्रण से बाहर करने के लिए संविधान में संशोधन किया है. क्या यह अनुमति योग्य है? मुझे नहीं लगता कि किसी भी फैसले ने इसे कवर किया है. हम इस मसले को संविधान पीठ के समक्ष भेजना चाहते हैं. सुप्रीम कोर्ट अब इस मामले की सुनवाई गुरुवार को करेगा.
वहीं केंद्र और दिल्ली सरकार के बीच पावर को लेकर तनातनी फिर से सुप्रीम कोर्ट पहुंच गई है. दिल्ली सरकार की ओर से DERC के अध्यक्ष पद पर पूर्व जज जस्टिस उमेश कुमार की नियुक्ति को चुनौती देने वाली याचिका पर आज सुप्रीम कोर्ट में सुनवाई शुरू हुई. सुनवाई के दौरान सीजेआई ने कहा कि मुख्यमंत्री और उपराज्यपाल को बैठकर नियुक्ति करनी चाहिए.
